Mediation - taking bookings from February 2023

What is mediation?

As a neutral third party, a mediator can help parties to negotiate conflicts and come up with an acceptable way forward for both parties.

Mediators are qualified in conflict resolution and are trained in both the negotiation and resolution of any type of conflict and dispute. In particular, mediators that are trained in facilitative mediation ask questions; acknowledge and rephrase the parties’ points of view and emotions; search for interests underneath the positions taken by parties; and assist the parties in finding and weighing up any options for resolution.

The facilitative mediator does not make recommendations to the parties, give his or her own advice or opinion as to the outcome of the case, or predict what a court would do in the case. The mediator is in charge of the process, while the parties are in charge of the outcome.

Whether the dispute is with your former partner, colleague, fellow student, family member, co-worker or neighbour, a mediator can assist both parties to try and improve the conflict and resolve any disputes between you.

Mediation can save you thousands in additional expenses, or from going to court to resolve your issue.

Mediation focuses on finding practical solutions that work for everyone and:

  • Can be arranged very quickly

  • Is an informal and confidential process

  • provides a way to have a say in the outcome.

Our principal lawyer Mary-Jean Lewis has recently completed training to become a qualified mediator and will now offer this service in the Shoalhaven.
